Free Consultation Terms & Acknowledgement V1.0
These terms apply to any complimentary consultation (“Session”) provided by Anchor Group LLC (“we,” “our,” “us”) to businesses with which we do not have an existing service relationship. By booking or participating in a Session, you (“you,” “your”) agree to the following:
1. Confidential Information
During the Session, you may share non-public or proprietary information (“Confidential Information”). We will not disclose your Confidential Information to third parties, except as needed with our trusted providers to provide you the information you seek during the Session, and as required by law. In the event you provide us with any access information including login credentials, it is your full responsibility to terminate our access.
2. Scope and No Ongoing Obligation
The Session is a limited, exploratory consultation of variable duration. It does not create a client relationship or obligate either party to enter into one. Any advice, recommendations, or work performed is provided solely for your consideration, and you are solely responsible for deciding whether and how to implement it.
3. Authorization and Access
By entering into this agreement, you represent that:
- You have the legal right and authority to grant us access to your NetSuite Account
- All information provided to us is accurate and reliable.
4. Recording of Session
You consent to our recording of the Session (audio, video, and/or screen sharing) for our internal reference, training, and quality assurance purposes. Recordings will not be shared publicly without your written permission, but they may be used internally.
5. Use of Anonymized Business Case
You grant us the right to use the facts, challenges, solutions, and outcomes discussed in the Session as part of marketing materials, including case studies, provided that we remove obvious identifying details of your business unless you give us explicit written permission to use your business name or other identifiable information.
6. No Warranty
The Session is provided “AS IS” and without any warranty, express or implied, including but not limited to warranties of accuracy, completeness, performance, or fitness for a particular purpose. We are not responsible for identifying, documenting, or addressing any pre-existing issues, errors, misconfigurations, vulnerabilities, or problems in your NetSuite environment or other systems. The purpose of the Session is to provide you with some of Anchor’s expertise in optimizing companies’ ability to utilize NetSuite. Please keep in mind that the Session is limited in scope, and without the ability to fully delve into your system and your business, we are not able to provide you with comprehensive advice, and we make no representations or warranties regarding the overall health, security, compliance, or optimization of your systems, whether or not such items are discussed or worked on during the Session.
7. Limitation of Liability
Our goal is to provide you with useful information to power your company. However, you understand that we have not yet been given the opportunity to fully learn your company and optimize your NetSuite. To the fullest extent permitted by law, our total liability for any claims arising out of or related to the Session will be $0 (zero dollars). We are not liable for indirect, incidental, special, or consequential damages of any kind.
8. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, or damages arising out of your use of or reliance on any recommendations, advice or information provided in a Session, your granting of system access, or your breach of the terms and conditions of this agreement.
9. Governing Law and Venue
This Agreement shall be governed by and shall be construed in accordance with the laws of the State of Wisconsin (irrespective of such state’s choice of laws rules), and the Circuit Court for Dane County, Wisconsin shall be the appropriate venue for any legal action.
10. Marketing and Promotional Emails
You agree to receive marketing and promotional emails from us.
