Free Bundle License and Disclaimer terms V1.0

These terms apply to any free software (“bundle”) provided by Anchor Group LLC (“Anchor Group”) to you. By  receiving the bundle you agree to the following:

  1. Marketing and Promotional Emails. You agree to receive marketing and promotional emails from Anchor Group during the time period of the License, in exchange for the License.
  2. Ownership & Restrictions
    All intellectual property and ownership rights, title, and interest in and to the bundle, including, without limitation, all source code, scripts, logos, images, and documentation, remain the exclusive property of Anchor Group.
    You may not:
    • Copy, modify, reverse-engineer, decompile, or create derivative works of the bundle.
    • Distribute, sell, sublicense, or otherwise transfer the bundle to any third party.
    • Use the bundle to provide a competing product or service.
    • Use the bundle for any purpose other than the purpose identified herein.
  3. License Grant
    Anchor Group grants you a limited, non-exclusive, non-transferable, royalty free, license (the “License”) to install and use the provided bundle solely within your own NetSuite account for internal business purposes, and for no other purpose.
  4. No Warranty / “As-Is” / No Support or Updates
    The bundle is provided as-is and as-available, without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.  We make no representations regarding the bundle's compatibility with any particular NetSuite versions or other third-party software.
  5. Limitation of Liability
    Anchor Group’s total liability for any claims or damages arising out of your use of the bundle is limited to the lesser of (i) $100, or (ii) the total fees paid by you to use the bundle. We are not liable for damages, losses, or costs (including loss of profits, data, or business interruption) arising from or related to your use of the bundle, even if we have been advised of the possibility of such damages.

  7. Data Privacy and Legal Compliance

We are under no obligation to provide maintenance, updates, bug fixes, or technical support for the bundle. 

You agree to indemnify and hold harmless Anchor Group and its owners, officers, employees, and contractors from any third party claims, damages, or expenses, including attorney’s fees,  arising from your (i) improper use of the bundle; (ii) failure to provide accurate information to Anchor Group; or (iii) breach of these terms.

You are solely responsible for the privacy of any data processed through the bundle, and ensuring compliance with all laws applicable to your use of the bundle. 

  1. Governing Law and Venue

  2. License Termination
     The License will automatically terminate upon your breach of these terms. Upon termination, you must remove the bundle from your NetSuite account immediately.

This Agreement shall be governed by and shall be construed in accordance with Wisconsin law, with any dispute handled in the Circuit Court for Dane County, Wisconsin.

By checking the box on the bundle request form, you acknowledge that you have read, understood, and agree to these terms.
